Martavious Kincaide, Gun Theft, Kentucky 2023

LOUISVILLE, KY – A brazen burglary targeting a local firearms dealer landed Martavious Kincaide, 29, of Jefferson County, Kentucky, a decade in federal prison. Kincaide was sentenced yesterday to 10 years, followed by a 3-year supervised release, for stealing guns and illegally possessing one of them.

According to court documents, on November 25, 2021, Kincaide, already a convicted felon, broke into a licensed firearms dealer and made off with an undisclosed number of firearms. Less than two weeks later, on December 6, 2021, Louisville Metro Police Department officers found Kincaide in possession of a Springfield Armory XD-M, 9-millimeter handgun – a weapon directly linked to the November burglary. Kincaide later confessed to the theft.

The U.S. Attorney’s Office for the Western District of Kentucky announced the sentence, a result of a joint investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Louisville Field Division and the Louisville Metro Police Department (LMPD). Kincaide has also been ordered to pay $13,600 in restitution to the firearms dealer, but with no possibility of parole in the federal system, he’ll serve the full ten years.

“This case is yet another example of what occurs when our federal and local law enforcement partners have longstanding solid working relationships,” stated U.S. Attorney Michael A. Bennett. “ATF and LMPD have demonstrated over time that working together is a force multiplier resulting in a safer Louisville for all who live, work and visit here. I commend both agencies for their continued focus on fighting violent crime and removing crime guns from our streets.”

ATF Special Agent in Charge R. Shawn Morrow emphasized the agency’s focus on stemming the flow of illegal firearms. “To reduce violent crime, ATF targets the sources of crime guns,” Morrow said. “Many crime guns come from theft from vehicles, residences and sometimes gun stores. In Kentucky, ATF investigates every theft from federal firearm licensees, and we work hard to recover stolen guns before they can be used to harm our community.”

The successful prosecution was handled by Assistant U.S. Attorney A. Spencer McKiness. The case falls under the umbrella of Project Safe Neighborhoods (PSN), a nationwide initiative aimed at reducing violent crime and gun violence through collaboration between law enforcement and local communities. The Department of Justice launched a strengthened version of PSN in May 2021, focusing on building trust, supporting community organizations, and strategic enforcement.
