Columbus, OH – A Columbus man has been sentenced to over two and a half years in federal prison for a string of air conditioner thefts that also resulted in the illegal release of harmful refrigerant into the atmosphere. Martin Chester Eldridge III, 35, received a 31-month sentence on November 7, 2014, after pleading guilty to violating the Clean Air Act.
According to court documents, Eldridge and accomplices stole at least 49 air conditioning units between August and October 2013. The units were targeted for their copper and other recyclable parts, which were then sold at local scrap yards. However, the method of theft – cutting the refrigerant lines – proved to be a federal offense. Each time Eldridge severed the tubing, he knowingly vented HCFC-22, a refrigerant commonly known as R-22, Freon, Genetron, or Forane, into the environment.
The U.S. Environmental Protection Agency (EPA) and the U.S. Attorney’s Office for the Southern District of Ohio took a firm stance on the case, recognizing the environmental damage caused by the refrigerant release. HCFC-22 is a Class II ozone-depleting substance regulated under the Clean Air Act, posing a significant threat to the Earth’s ozone layer. Randall K. Ashe, Special Agent in Charge of EPA’s criminal enforcement program in Ohio, stated the sentence demonstrates the agency’s commitment to protecting both the ozone layer and communities impacted by such illegal activity.
Legal Ramifications
Eldridge was charged with violating 42 U.S.C. 7413(c)(1) of the Clean Air Act, specifically the provision prohibiting the knowing release of regulated substances into the atmosphere. He pleaded guilty in June 2014. In addition to the 31-month prison sentence (with 280 days already served due to prior state charges), Eldridge was sentenced to three years of supervised release and ordered to perform 200 hours of community service following his incarceration. The federal sentence is being served concurrently with a state sentence Eldridge received for the theft charges themselves. He has been in custody since October 2, 2013.
First of its Kind
U.S. Attorney Carter M. Stewart noted that this case marks the first federal prosecution of its kind in the Southern District of Ohio, highlighting the increasing attention being paid to environmental crimes linked to property theft. The successful prosecution was the result of a collaborative investigation involving the Columbus Division of Police, the U.S. EPA, and a local scrap metal theft task force. Assistant U.S. Attorneys J. Michael Marous, Heather B. Robinson, and Brad Beeson were instrumental in securing the conviction.
