Guatemalan Illegal Alien Convicted of Reentering US After Attempted Rape Charge
Maynor Perez Baten, a 36-year-old Guatemalan national, has been found guilty of reentering the United States illegally after serving time for attempted rape of a 12-year-old girl. The verdict was handed down in Brooklyn federal court yesterday.
Perez Baten was first arrested in 2011 for first-degree rape, but was convicted of attempted rape in 2011 and sentenced to 42 months in prison. He was released in 2014 and deported to Guatemala, only to return to the US without permission in 2022. When he was caught driving drunk in Staten Island, he was indicted for illegal reentry.
Tuesday’s conviction comes after a two-day trial, during which prosecutors argued that Perez Baten showed ‘brazen contempt for community safety and the rule of law.’ ‘He has no respect for the laws of our nation,’ said US Attorney Joseph Nocella. ‘He will be returned to Guatemala after completing his sentence.’
‘Maynor Perez Baten’s attempted rape of a child and his subsequent decision to illegally re-enter the United States highlight his flagrant and repeated disregard for the criminal justice system,’ said HSI New York Acting Special Agent in Charge Michael Alfonso. ‘His choice to return after removal, without authorization and despite his depraved felony record, demonstrates a brazen contempt for community safety and the rule of law that protects it.’
Perez Baten faces up to 20 years in prison when sentenced. The government’s case is being handled by the Office’s General Crimes Section, with Assistant US Attorney Vincent Chiappini leading the prosecution.
The defendant’s case is a stark reminder of the consequences of reentering the US after a felony conviction. ‘He has shown no respect for the laws of our nation,’ said Nocella. ‘He will be held accountable for his actions.’
Perez Baten’s sentencing is set for a later date. He is being held without bail pending his sentencing hearing.
