Addison, TX – A Texas contractor was sentenced to over a year in prison for knowingly violating federal environmental regulations and defrauding a real estate company during a 2001 demolition project. Melvin Eugene Riecke II, of Addison, was convicted in January 2007 on four counts related to the improper handling and illegal dumping of asbestos-containing materials.
According to court documents, Riecke and his crew demolished a former lumber and hardware store in November and December 2001. A pre-demolition survey clearly indicated the presence of asbestos within the building’s structure. Despite this knowledge, and a contractual obligation to adhere to asbestos removal regulations, Riecke deliberately bypassed federal workplace standards and instead directed his team to dump the hazardous material at an unauthorized site in West Dallas. This reckless disregard for public and worker safety exposed individuals to potentially deadly asbestos fibers.
The Environmental Protection Agency (EPA) launched an investigation, uncovering a pattern of intentional non-compliance. Riecke not only failed to properly remove and dispose of the asbestos, but also falsified information related to the demolition process. This included submitting false statements as part of his contractual agreement with Beltway Development Company, the property owner. The illegal dumping created a significant health risk, as asbestos exposure is a known cause of severe respiratory illnesses including lung cancer, asbestosis, and mesothelioma – a particularly aggressive form of cancer affecting the lining of the lungs and abdomen.
Riecke was initially charged in July 2006 with a four-count superseding indictment. The charges included one count of making false statements (18 U.S.C. 1001), one count of mail fraud (18 U.S.C. 1341), and two counts of violating the Clean Air Act (42 U.S.C. 7412(f)(4)). Following a trial, Riecke was found guilty on all counts. The severity of the violations, coupled with the intentional nature of the deceit, led to a substantial penalty.

On January 31, 2007, Riecke was sentenced to 15 months of incarceration, followed by 24 months of probation. He was also ordered to pay a $400 special assessment fee and $1,604 in restitution to Beltway Development Company to cover the costs associated with the improper demolition and subsequent cleanup. This case highlights the EPA’s commitment to pursuing criminal charges against individuals who knowingly endanger public health and violate environmental laws.
