Michael Scott Hearon, 46, faces up to 20 years in custody and/or a $1,000,000 fine after being indicted on charges of Conspiracy to Distribute a Controlled Substance and Possession with Intent to Distribute a Controlled Substance in Eagle Butte, South Dakota.
According to court documents, Hearon was indicted on November 13, 2014, for allegedly conspiring and agreeing with others to distribute and possess with intent to distribute methamphetamine, a Schedule II controlled substance, between June 22, 2013, and February 3, 2014.
The indictment also alleges that Hearon knowingly and intentionally distributed and possessed with intent to distribute methamphetamine and marijuana on June 22, 2013, and October 18, 2013.
Assistant U.S. Attorney Jay Miller is prosecuting the case, with the Federal Bureau of Investigation and Bureau of Indian Affairs conducting the investigation.
Hreon was remanded to the custody of the U.S. Marshals Service pending trial, with a trial date yet to be set.
The charges against Hearon are mere accusations, and he is presumed innocent until proven guilty.
The maximum penalty upon conviction is 20 years in custody, a $1,000,000 fine, 3 years of supervised release, and $400 to the Federal Crime Victims Fund, with restitution also possible.
