Michael J. Frascatore, Failing to Register Email Address, New York 2024

A sex offender in New York has pleaded guilty to failing to register an email address, a crime that carries a maximum term of 10 years in prison and a fine of up to $250,000.

Michael J. Frascatore, 59, of Treadwell, New York, was convicted in federal court in 2008 for distributing child pornography and was designated as a Level I sex offender.

Frascatore knew that as a registered sex offender, he was required to report all email addresses he used, but he failed to disclose an email address he created in April 2019, which he maintained for approximately four years without registering it as required under the Sex Offender Registration and Notification Act (SORNA).

In addition to failing to register the email address, Frascatore also admitted to violating the terms of his supervised release by using an unauthorized internet-capable phone, maintaining the undisclosed email account, and knowingly communicating with minors online, including by sending explicit photos of himself to minors and requesting nude photos in return.

Frascatore will be sentenced for the SORNA offense and for his violations of supervised release on May 2, 2024, by United States District Judge Anne M. Nardacci.

The United States Marshals Service investigated this case, which is being prosecuted by Assistant United States Attorney Michael F. Perry as part of Project Safe Childhood.

Project Safe Childhood is a program launched by the government in May 2006 to combat child exploitation and obscenity. The program is led by United States Attorney’s Offices and the Criminal Division’s Child Exploitation and Obscenity Section.

The SORNA offense carries a maximum term of 10 years in prison, a fine of up to $250,000, and a term of supervised release of at least 5 years and up to life. The supervised release violations carry a maximum term of 2 years in prison.
