CEOs of Steel Contractor Convicted of Fraud in M/WBE Program
Larry Davis, President and Chief Executive Officer of DCM Erectors, Inc., was convicted of engaging in a fraudulent scheme to violate the Port Authority’s Minority and Women-Owned Business Enterprise Program.
The scheme involved misrepresenting work performed by minority and women-owned businesses on the World Trade Center Project, a nearly billion-dollar construction contract. Davis was found guilty after an eight-day jury trial before U.S. District Judge Loretta A. Preska.
According to the indictment, Davis caused DCM to claim that certain work was performed by minority-owned business Solera/DCM Joint Venture LLC and a woman-owned business GLS Enterprises, Inc., when in truth and in fact, DCM itself performed such work or arranged for it to be performed by other non-M/WBE contractors.
The indictment also alleges that Davis directed Solera/DCM to place laborers who worked for a non-minority contractor on Solera/DCM’s payroll and then invoice DCM for such laborers’ time.
The Port Authority’s Minority and Women-Owned Business Enterprise Program is designed to ensure that minority and women-owned businesses receive work on its projects.
Davis faces sentencing and could face significant time behind bars.
