Montana Man Gets 3 Years Probation for Failure to Pay Child Support

A 28-year-old man from Browning, Montana, has been sentenced to 3 years of unsupervised probation and ordered to pay $15,718.21 in restitution for failure to pay legal child support, according to a recent court ruling.

Timothy L. Black Weasel was indicted by a federal grand jury on April 4, 2012, for failing to pay over $18,000 in past due child support, dating back to 2004. At the time of the indictment, Black Weasel had not made a child support payment since November 2010, resulting in a total arrearage amount of $18,516.65.

The court had originally ordered Black Weasel to pay $200 per month in child support commencing May 1, 2004, but the amount was later modified to $391 per month on July 1, 2008.

Black Weasel pled guilty to the charge on January 3, 2013, and was subsequently sentenced to 3 years of unsupervised probation by US District Judge Charles B. Kornmann. He was also ordered to pay a $100 special assessment to the Victim Assistance Fund and the aforementioned restitution amount.

The case was investigated by the Department of Health and Human Services, Office of Inspector General, and prosecuted by Assistant US Attorney Thomas J. Wright.
