Defendant Faces Probation for Firearms Violation

MARTINSBURG, WEST VIRGINIA – A Berkeley County man has been sentenced to three years of probation for a firearms violation, a crime punishable by law.

Nathan Johnson, a 45-year-old resident of Martinsburg, West Virginia, pleaded guilty in January 2020 to one count of "Unlawful Possession of a Firearm." Johnson admitted to having 34 firearms in his possession in March 2017 in Berkeley County, despite being prohibited from doing so.

Johnson’s case was prosecuted by Assistant U.S. Attorney Timothy D. Helman, who represented the government. The Bureau of Alcohol, Tobacco, Firearms and Explosives investigated the matter, uncovering the extent of Johnson’s illicit firearm collection.

U.S. Attorney William J. Ihlenfeld, II announced the sentencing, stating that Johnson’s actions warrant serious consequences. "This case demonstrates the seriousness with which we take firearms violations," Ihlenfeld said.

Chief U.S. District Judge Gina M. Groh presided over the case, ordering Johnson to pay a $5,000 fine and to forfeit 36 firearms, as well as thousands of rounds of ammunition. Johnson’s probationary sentence will serve as a reminder to others who would attempt to circumvent the law.

The case serves as a stark reminder that firearms laws are in place to protect the public and maintain public safety. Johnson’s actions demonstrate a blatant disregard for these laws and put the community at risk.
