Nicholas Heriberto Vallecillo-Tejada, Illegal Re-Entry, Pennsylvania 2023

SCRANTON – A federal jury in the Middle District of Pennsylvania has convicted a previously deported Honduran man of illegal re-entry into the United States. Nicholas Heriberto Vallecillo-Tejada, age 39, was found guilty of re-entering the country without permission after being deported in 2008 and 2009.

According to the U.S. Attorney’s Office for the Middle District of Pennsylvania, Vallecillo-Tejada was deported from the United States to Honduras in November 2008 and again in July 2009. Despite this, he re-entered the country without first obtaining legal permission to do so.

Vallecillo-Tejada was encountered by the Shenandoah Police Department in Schuylkill County, Pennsylvania, on September 5, 2020, when he was arrested on charges which eventually led to convictions for simple assault and weapons possession. He was subsequently indicted by a federal grand jury in February 2022 and charged with illegal re-entry into the United States.

The U.S. Immigration and Customs (ICE) Enforcement and Removal Operations (ERO) investigated the case, with Assistant United States Attorneys Robert J. O’Hara and Brian J. Gallagher prosecuting the case.

Vallecillo-Tejada faces a maximum penalty of two years of imprisonment, a term of supervised release following imprisonment, and a fine. A sentence following a finding of guilt is imposed by the Judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.

The case was brought as part of the Department’s efforts to combat immigration-related crimes. The U.S. Attorney’s Office for the Middle District of Pennsylvania commends the Shenandoah Police Department and ICE for their work in bringing this case to justice.
