Hardrock Excavating LLC owner Ben Lupo faces serious federal charges after being accused of violating the Clean Water Act by discharging brine and oil-based drilling mud into Ohio’s Mahoning River.
Lupo, 62, from Poland, Ohio, is alleged to have directed an employee to illegally dump the materials into a stormwater drain on January 31, 2013. The discharge ultimately flowed into the river near Youngstown, causing significant environmental concern.
According to Steven M. Dettelbach, U.S. Attorney for the Northern District of Ohio, this case serves as a stark reminder of the consequences of polluting waterways. ‘Whether our water flows south to the Ohio River or north to the Great Lakes, protecting and preserving clean and safe water remains a priority,’ Dettelbach stated.
The Ohio Department of Natural Resources (ODNR) Director Jim Zehringer emphasized that ODNR will continue to aggressively pursue those who disregard environmental laws. ‘This charge should serve as a warning to anyone that places their personal interests ahead of the public’s safety,’ Zehringer said.
Ohio EPA Director Scott Nally echoed these sentiments, stating, ‘Knowingly polluting the waters of our state is a violation of the Clean Water Act, and we will pursue criminal prosecution to protect the health and safety of the public.’
Ohio Attorney General Mike DeWine vowed to assist with federal water pollution prosecution in this case and work closely with ODNR to address all other violations. ‘Ohio’s waters must be protected for the health and safety of its citizens and the state’s wildlife,’ DeWine said.
