Oregon Man Pleads Guilty to .50 Caliber Machine Gun Charge
EUGENE, Ore. – A John Day man pleaded guilty to unlawful possession of a .50 caliber machine gun that was not registered to him. Michael Ray Emry, 54, of John Day faces a maximum sentence of 10 years in prison, a $10,000 fine, and three years of supervised release, as he awaits sentencing on April 3, 2017.
Emry admitted to stealing a Browning M2 machine gun with an obliterated serial number from a man in Idaho and bringing it to Oregon. He told federal agents that the firearm was fully automatic and could fire between 550 and 650 rounds per minute.
The weapon was recovered on May 6, 2016, during a search warrant at Emry’s trailer in John Day. The case was investigated by the FBI in close collaboration with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
Prosecutor Nathan J. Lichvarcik, Assistant United States Attorney for the District of Oregon, is handling the case. Judge Ann Aiken accepted Emry’s guilty plea on Monday, January 23, 2017.
Emry’s sentencing hearing is scheduled for April 3, 2017. The guilty plea marks a significant development in the case, which has garnered attention for the severity of the charges.
