Attorney General Ken Paxton has fought off a brazen attempt by an Oklahoma property owner to seize Texas land along the Red River. The AG’s office successfully secured a court order to block the expansionist scheme.
In a lawsuit filed in August 2025, the Oklahoma landowner sought to “quiet title” over parts of Texas’s Red River property, arguing that the state border had shifted due to changes in the river’s lower bank. This case rested on an outdated 1923 Supreme Court opinion rather than the 1999 Red River Boundary Compact, which Congress approved in 2000.
The lawsuit targeted several Texas landowners, including the State of Texas itself. Paxton led the charge to defend Texas’s sovereignty alongside the Texas Department of Transportation, which brought in outside counsel for assistance with out-of-state filings.
Paxton argued that the Oklahoma property owner could not sue Texas without its consent and relied on incorrect authority to determine state borders. The Motion to Dismiss was granted, removing Texas from the lawsuit.
“The full force of the law will come crashing down on anyone trying to seize Texas land,” Paxton declared. “I will always defend our state’s sovereignty and won’t allow erroneous theories to undermine Texas’s land ownership.”
This victory in court marks another victory for Texas against encroachment by neighboring states, ensuring that the Red River Rivalry remains a sports term rather than a legal dispute.
