Peggy Eischens, Willful Failure to Pay Over Taxes, Minnesota 2014

MINNEAPOLIS, MINN. – A business owner has been sentenced to prison for failing to pay over $200,000 in employment taxes, according to the U.S. Attorney’s Office.

Peggy Eischens, 45, of LeSueur, Minn., was sentenced to one year and one day in federal prison for her role in willfully failing to pay over federal income taxes and Federal Insurance Contribution Act (FICA) taxes to the IRS.

Between 2002 and 2011, Eischens was a co-owner and employee of R.D. Hanson Associates, Inc., which operated under the names Kernel Pops of Minnesota and Kernel Concession Supply.

According to court documents, Eischens was responsible for handling payroll and accounting for the company, including preparing employee paychecks and filing Form 941 quarterly tax returns with the IRS.

However, between 2003 and 2011, Eischens willfully failed to pay over to the IRS federal income taxes and FICA taxes deducted and collected from the wages of RDHA employees.

Totaling approximately $201,285, the withheld federal income taxes, withheld FICA taxes, and the employer’s share of FICA taxes were never paid to the IRS.

The case was the result of an investigation conducted by the Internal Revenue Service-Criminal Investigations, with Assistant U.S. Attorney Joseph H. Thompson prosecuting the case.

Eischens pleaded guilty on October 14, 2014, to one count of Willful Failure to Pay Over Taxes and was sentenced on February 4, 2015, before Judge Michael J. Davis in U.S. District Court in Minneapolis.

She will also serve three years of supervised release following her prison sentence.
