Rochester Man Sentenced to 78 Months in Prison for Possession of Heroin and Firearm
A 31-year-old man from Rochester, New York, has been sentenced to 78 months in prison for possession of heroin with intent to distribute and being a convicted felon in possession of a firearm, according to U.S. Attorney William J. Hochul.
Peter Barclay was convicted of the charges and sentenced by U.S. District Judge Elizabeth A. Wolford. Assistant U.S. Attorney Charles E. Moynihan handled the case.
The investigation into Barclay’s activities began on May 17, 2012, when Rochester Police Officers responded to a report of a single shot being fired in the area of Ellison Street. Officers approached Barclay, who was with another person, to see if they had information about the incident.
Barclay became verbally abusive towards the officers and, when asked for identification, threw his New York State Identification on the ground near the officers. He then ran into the residence at 214 Ellison Street, where officers found a .9mm semi-automatic pistol, ammunition, and approximately 445 grams of heroin.
Barclay admitted to possessing both the firearm and the heroin. The sentencing is the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Special Agent in Charge Delano A. Reid, New York Field Office and the Rochester Police Department, under the direction of Chief Michael Ciminelli.
