Port of Edmonds Fined $3,522 for ADA Violations
Seattle, Washington – In a shocking case of disability discrimination, the Port of Edmonds, Washington has been found guilty of violating the Americans with Disabilities Act (ADA) and has been fined $3,522 in damages.
The Port, located in Edmonds, Washington, was accused of altering the parking lot at the Port marina and failing to provide appropriate accessible parking spaces, according to a complaint filed with the U.S. Attorney’s Office. The complaint, which was resolved last year, alleged that the Port’s actions prevented individuals with mobility issues from accessing the marina.
According to the settlement agreement, the Port of Edmonds reconfigured its parking lot in February 2021, constructing a dumpster area where accessible parking had been. The complainant notified the Port of Edmonds that the new configuration violated the ADA, but the Port did not make any changes. It wasn’t until August 2021, after a representative from the U.S. Attorney’s Office viewed the parking areas, that the Port reconfigured its parking spaces to include accessible spaces with access aisles and designated van accessible areas.
The Port of Edmonds has agreed to designate an ADA coordinator, who will be responsible for investigating any complaints regarding discrimination against individuals with disabilities. The Port will also pay the complainant who could not use Port facilities $3,522 and agrees in the settlement not to retaliate in any way against anyone who brings a complaint regarding ADA access.
The matter was investigated and resolved by former Assistant United States Attorney Sarah Morehead and subsequently by Assistant United States Attorney Heather Costanzo.
The Port of Edmonds will certify its compliance with the ADA to the U.S. Attorney’s Office and will be monitored for two years following the settlement. If no further issues arise, the matter will be closed.
The exact criminal charges against the Port of Edmonds were not specified in the source, but the outcome is that the Port has agreed to pay damages and make changes to its parking lot to comply with the ADA.
