Princess Cruise Lines Ltd. has been ordered to pay a hefty fine of $40 million for its role in dumping oil contaminated waste into the ocean and falsifying records, marking the largest-ever penalty for crimes involving deliberate vessel pollution.
The sentence was handed down by U.S. District Judge Patricia A. Seitz in Miami, with the cruise line also facing five years of probation. As part of its sentence, Princess will be required to implement an environmental compliance plan, including independent audits by an outside company and oversight by a court-appointed monitor.
The investigation, led by the U.S. Coast Guard, revealed that the company had been making illegal discharges through bypass equipment since 2005, with the most recent incident occurring on August 23, 2013, when approximately 4,227 gallons of oil contaminated waste were dumped into the ocean off the coast of England.
Engineers on board the Caribbean Princess, one of the ships involved in the scandal, used a so-called ‘magic pipe’ to conceal the discharges, running clean seawater through the ship’s monitoring equipment to create a false digital record for a legitimate discharge. Crew members also lied to authorities during inspections, following orders from engineering officers.
The company has already taken corrective actions, including upgrading the oily water separators and oil content monitors on every ship in its fleet and instituting new policies. However, the fine and sentence demonstrate the severity of the company’s crimes and the importance of holding businesses accountable for their environmental impact.
According to Acting U.S. Attorney Benjamin G. Greenberg, ‘Today’s large criminal penalty makes it clear that businesses that operate in our oceans will be held accountable for violating their obligation to safeguard the marine environment.’ The case serves as a warning to other companies involved in maritime activities to prioritize environmental compliance and transparency.
