Randy Blythe, Bankruptcy Fraud & Felon in Possession of a Firearm, Arkansas 2014

A Fort Smith man has been sentenced to 24 months in federal prison for bankruptcy fraud and being a felon in possession of a firearm.

Randall Bee ‘Randy’ Blythe, 58, was sentenced on the charges following a four-day jury trial in November 2014.

According to court records, Blythe fraudulently concealed assets from his creditors and the Bankruptcy Court by transferring property, including six collector automobiles and over $150,000 in checks, to his mother’s company, Classic Cars of Northwest Arkansas.

Blythe also submitted a false Statement of Financial Affairs, omitting the transfers and income.

He was originally indicted by a federal grand jury in March 2014, charging him with devising a scheme to defraud his creditors, the bankruptcy trustee, and the Bankruptcy Court.

Blythe’s wife, Greta Blythe, filed a Chapter 7 bankruptcy petition in April 2009, listing assets of only $460,090.28. However, Blythe controlled various business entities involved in the sale of used vehicles, including ‘classic’ or ‘collector’ cars.

Blythe was granted a discharge by the Bankruptcy Court in July 2009, but the sentence imposed on him on December 2014, included 24 months in federal prison, followed by three years of supervised release, and ordered to pay $468,309.58 in restitution.

The case was prosecuted by the U.S. Attorney’s Office for the Western District of Arkansas, with assistance from the Federal Bureau of Investigation.
