The decision comes as the state prohibition law has been repealed, rendering the federal case invalid. On October 4, 1929, Tom Brent and another Delevan man were arrested and brought before a Walworth county justice of the peace, but their case was dismissed due to the state’s inability to prosecute under the repealed law.
