A 23-year-old Rosebud woman will face the music after pleading guilty to Possession with Intent to Distribute a Controlled Substance. Patricia Pacheco appeared before U.S. District Judge Roberto A. Lange on April 2, 2013 and took the plea deal.
The maximum penalty upon conviction is 5 years of imprisonment, a $250,000 fine, or both; at least 2 years of supervised release and an additional 2 years of supervised release upon revocation. Restitution and a $100 special assessment may also be ordered.
The charge stems from an incident on March 21, 2012 wherein Pacheco’s vehicle and residence were searched. Controlled substances and drug paraphernalia were found.
The investigation was conducted by the Northern Plains Safe Trails Drug Enforcement Task Force and the Rosebud Sioux Tribe Law Enforcement. Assistant U.S. Attorney Kathryn N. Rich is prosecuting the case.
Pacheco was remanded to the custody of the U.S. Marshal Service pending sentencing, which has been set for June 24, 2013.
According to the investigation, Pacheco’s vehicle and residence were searched on March 21, 2012, resulting in the discovery of controlled substances and drug paraphernalia.
The case is a stark reminder of the ongoing struggle against drug trafficking in rural areas of South Dakota. As the investigation continues, Pacheco’s sentencing will serve as a warning to those involved in similar crimes.
