Russell Duane Hubbeling, Failure to Register as a Sex Offender, South Dakota 2021

A Mitchell, South Dakota, man has been charged with a serious crime.

Russell Duane Hubbeling, 57, has been indicted by a federal grand jury for Failure to Register as a Sex Offender.

According to Acting United States Attorney Dennis R. Holmes, Hubbeling’s indictment alleges that he failed to register under the Sex Offender Registration and Notification Act between August 5, 2021, and September 2, 2021.

The maximum penalty upon conviction is up to 10 years in federal prison and/or a $250,000 fine, life of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.

Hubbeling appeared before U.S. Magistrate Judge Veronica L. Duffy on October 8, 2021, and pled not guilty to the Indictment.

The investigation is being conducted by the U.S. Marshals Service. Assistant U.S. Attorney Jeffrey C. Clapper is prosecuting the case.

Hubbeling was remanded to the custody of the U.S. Marshals Service pending trial, which has been set for December 14, 2021.

The charge is merely an accusation and Hubbeling is presumed innocent until and unless proven guilty.
