Anthony Cunningham, Maintaining a Drug Haven, Ohio 2013

Salineville, Ohio – Federal prosecutors have dropped the hammer on Anthony Cunningham, a 56-year-old resident of Salineville, charging him with maintaining a drug haven and being a felon in possession of a firearm.

The United States Attorney for the Northern District of Ohio, Steven M. Dettelbach, announced that a federal grand jury returned a two-count indictment against Cunningham. The first count alleges that from June to July 2013, Cunningham used a property on State Route 39 in Salineville as a base for distributing heroin and cocaine.

Count two of the indictment is equally severe, charging that on August 2, 2013, Cunningham had in his possession an American Derringer, model 1, .40 caliber firearm, along with Federal .40 caliber ammunition. This marks a violation of his previous convictions for bank robbery and felonious assault with a firearm specification.

Should Cunningham be found guilty on these charges, the sentencing will be determined by the court after considering unique factors such as his prior criminal record, role in the offense, and the characteristics of the violations. Sentences are not expected to exceed the statutory maximum, which, in most cases, will be significantly less.

The investigation leading to these charges was a collaborative effort between the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Columbiana County Task Force. Assistant United States Attorney David M. Toepfer is handling the prosecution of this case.

It’s important to note that an indictment is merely a charge and does not constitute evidence of guilt. Cunningham is entitled to a fair trial, where the government will bear the burden of proving his guilt beyond a reasonable doubt.
