Sex Offender Caught, Fails to Register
A 30-year-old Guatemalan national, Edward Jacinto Garcia, has pleaded guilty to failing to register as a sex offender in Pennsylvania, according to a federal indictment.
Garcia, a citizen of Guatemala, was found in Butler County, Pennsylvania, after being arrested and charged with driving under the influence by the Butler Township Police Department on July 6, 2015. Prior to his arrest, Garcia had been deported from the United States after serving a period of imprisonment for sexual assault of a minor in the state of Nebraska.
According to the indictment, Garcia was required to register as a sex offender under the provisions of the Sex Offender Registration and Notification Act. However, he failed to do so in the state of Pennsylvania, where he was employed during the period of June 2015 through July 6, 2015.
Garcia’s guilty plea includes two counts: illegal re-entry after deportation and failing to register as a sex offender. He faces a maximum total sentence of 30 years in prison, a fine of $500,000, or both. Judge Gustave Diamond scheduled sentencing for May 11, 2016, at 10 a.m.
The investigation leading to Garcia’s prosecution was conducted by the Department of Homeland Security, Immigration and Customs Enforcement, and the United States Marshals Service. Assistant United States Attorney Carolyn J. Bloch is prosecuting the case on behalf of the government.
Garcia remains in custody pending the sentencing hearing. Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and Garcia’s prior criminal history.
