Burglary and Sexual Abuse plague communities across the nation, and South Dakota is no exception. In a disturbing case that highlights the severity of these crimes, Shawn Iron Hawk, a 25-year-old man from Eagle Butte, South Dakota, has been charged with First Degree Burglary and Aggravated Sexual Abuse.
The charges against Iron Hawk were brought forth by U.S. Attorney Ron Parsons following an indictment by a federal grand jury on February 20, 2019. Iron Hawk appeared before U.S. Magistrate Judge Mark A. Moreno on March 18, 2019, and pled not guilty to the Indictment.
The maximum penalty for conviction is up to life in federal prison and/or a $250,000 fine, 5 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The Indictment alleges that on December 30, 2018, Iron Hawk entered a home occupied by an individual and sexually assaulted the victim. The charges are merely accusations, and Iron Hawk is presumed innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Jay Miller is prosecuting the case.
Iron Hawk was released on bond pending trial. A trial date has not been set.
In a statement, authorities emphasized the severity of the charges and the potential consequences for conviction. The case serves as a reminder of the importance of community vigilance and cooperation in preventing such crimes.
