PHOENIX, AZ – Jorge Adan Fontes-Garcia, 26, a citizen of Mexico, will spend over a decade in federal prison after one of his smuggled charges died of heat exposure in the unforgiving Arizona desert. Fontes-Garcia was sentenced on August 5th by U.S. District Judge James A. Teilborg to 130 months incarceration, followed by 60 months of supervised release. He previously pleaded guilty on May 20th to Bringing an Illegal Alien to the United States Unlawfully Resulting in Death.
The grim details unfolded on August 23, 2023. Fontes-Garcia acted as a foot guide, leading a group of eight undocumented immigrants across the border near Tacna, Arizona. While U.S. Border Patrol agents apprehended seven of the individuals approximately 19 miles north of the border, one was discovered deceased – a victim of the brutal desert heat. The victim’s identity has not been released. Fontes-Garcia’s sentence also accounted for a violation of federal supervision stemming from a prior conviction for Reentry of an Illegal Alien, highlighting a pattern of disregard for U.S. law.
“This case demonstrates that human smugglers often have little regard for those entrusted to their care,” stated U.S. Attorney Timothy Courchaine. “My message to those trying to cross the border illegally is that their actions are not just a violation of the law, they can also lead to tragic consequences.” The sentiment reflects a growing frustration within the Department of Justice regarding the callous disregard for human life exhibited by those profiting from illegal border crossings.
Yuma Sector Border Patrol Chief Patrol Agent Justin De La Torre was blunt in his assessment: “Human smuggling results in numerous deaths every year as smugglers are more concerned with profit than the lives of the people they are smuggling.” De La Torre emphasized that Fontes-Garcia’s lengthy sentence should serve as a deterrent to others considering similar criminal activity. “This sentence sends a clear message to anyone considering smuggling foreign nationals into the country – ‘if you do, we will arrest you, and you will be held accountable.’”
The prosecution of Fontes-Garcia is part of “Operation Take Back America,” a nationwide initiative aimed at bolstering resources to combat illegal immigration, dismantle cartels and transnational criminal organizations, and protect communities from violent crime. The operation integrates the efforts of the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood, signifying a coordinated, multi-agency approach.
The investigation was conducted by Customs and Border Protection’s United States Border Patrol, with prosecution handled by the United States Attorney’s Office, District of Arizona, Phoenix.
