Spearfish Man Sentenced for Child Pornography Attempt

A 70-year-old Spearfish man has been sentenced to prison for attempting to receive child pornography. Stanley Lee Lumbardy, 70, was convicted of Attempted Receipt of Child Pornography and sentenced to five years in federal prison followed by five years of supervised release.

According to authorities, Lumbardy was arrested and federally indicted as a result of an undercover sex trafficking operation conducted during the 2019 Sturgis Motorcycle Rally. He was targeting internet predators and was caught after exchanging multiple chats with an undercover agent posing as a 15-year-old girl.

Lumbardy requested photos from the undercover persona and negotiated a time and place to meet the minor for unlawful sex acts. However, when he arrived at the pre-determined location, he was met by law enforcement agents and placed under arrest.

The case was investigated by Homeland Security Investigations, South Dakota Division of Criminal Investigation, Internet Crimes Against Children Task Force, Rapid City Police Department, and the Pennington County Sheriff’s Office. Assistant U.S. Attorney Sarah B. Collins prosecuted the case.

Lumbardy will also be required to register as a sex offender under the Sex Offender Registration and Notification Act and pay a $100 special assessment to the Federal Crime Victims Fund and a $5,000 special assessment to the Victims of Trafficking Fund.

He was immediately turned over to the custody of the U.S. Marshals Service after the sentencing. The public is advised to be cautious of predators like Lumbardy and report any suspicious activity to the authorities.

The sentence is a reminder that law enforcement agencies are working tirelessly to protect children from exploitation and that those who commit such crimes will face severe consequences.
