Alice M. Foss, 53, of Springfield, Illinois, has pleaded guilty to embezzling over $400,000 from her former employer, Don Moss and Associates, a consulting and lobbying firm. The firm specializes in services for disabled persons and other social causes.
In a hearing before U.S. District Judge Sue E. Myerscough, Foss admitted to writing fraudulent bonus checks from the firm’s bank account, totaling approximately $144,852. She also used the firm’s bank account and credit card to pay personal expenses, including checks and wire transfers, totaling more than $200,000.
The fraud scheme involved Foss using the firm’s bank account and credit card to pay for personal expenses, including car payments, donations to a private school, and mailing payments to personal credit cards. She also used the credit card to pay for clothing, groceries, gas, car washes and rentals, hotel rooms, hair salon and spa expenses, and veterinary bills.
Foss was charged with mail fraud (five counts), wire fraud (seven counts), and access device fraud (one count). The charges are the result of an investigation by the U.S. Postal Inspection Service and the FBI. Assistant U.S. Attorney Timothy A. Bass is prosecuting the case.
The plea agreement includes a recommendation of no more than 57 months in prison, based on the advisory sentencing guideline range of 46 to 57 months. Foss has agreed to pay restitution in excess of $400,000. Sentencing is scheduled for May 26, 2015.
Foss remains on bond pending sentencing. Her guilty plea marks the end of a three-day evidentiary hearing in the case. The case will now proceed to sentencing.
Foss’s actions put the trust of her employer and the public at risk, highlighting the importance of thorough financial oversight and accountability. Her case serves as a reminder of the devastating consequences of embezzlement and the need for strong enforcement of financial laws.
