Justimiano Perez Diaz, 43, of Stigler, Oklahoma, has admitted to using the internet to lure a child he believed to be 13 years old into sexual activity, pleading guilty to Enticement Of A Minor Using The Internet, a federal crime punishable by not less than 10 years imprisonment and up to a $250,000.00 fine, or both.
The indictment, filed in the Eastern District of Oklahoma, details how from around September 2017 through October 16, 2017, Diaz used interstate communications—specifically the internet—to attempt to persuade, induce, and entice an individual he thought was a minor. The targeted sexual acts would have violated Oklahoma State law under Title 21, Section 1123, which criminalizes lewd or indecent acts with a child under 16.
Diaz believed he was communicating with a real child, but the investigation was part of a coordinated law enforcement operation. Authorities have not disclosed whether the minor was an undercover agent or a fictional construct created during the sting, but such operations are standard in prosecuting online predators.
The case was jointly investigated by the Wagoner Police Department and the Federal Bureau of Investigation, agencies that have intensified efforts to catch predators exploiting digital platforms. The collaboration underscores the federal government’s aggressive stance on internet-facilitated sex crimes involving minors.
The plea was accepted by U.S. Magistrate Judge Steven P. Shreder in Muskogee, who ordered a presentence investigation report ahead of sentencing. That report will shape the final judgment, though Diaz faces a mandatory minimum of 10 years behind bars.
