Taiyo International Inc. has been found guilty of discriminating against a US citizen, according to a recent agreement with the federal government. The agreement states that Taiyo, a Minnesota-based company, took retaliatory action against the citizen after they reported discriminatory treatment during the hiring process.
According to the agreement, Taiyo rescinded a job offer to the citizen after they sent an email complaining about the treatment they received during the hiring process. The government investigation found that Taiyo employees had repeatedly asked the citizen about their nationality, citizenship status, and immigration documents during the interview process.
The US Attorney General’s office stated that the agreement will require Taiyo to pay a civil fine of $10,400 to the affected citizen and provide back pay and interest. Taiyo will also be required to post notices informing employees of their rights under the antidiscrimination provision of the Immigration and Nationality Act and provide training to its employees.
‘Employees and applicants must have the opportunity to voice their concerns about discrimination without being subjected to retaliatory actions that could deter them and others from asserting their rights,’ said Eric Dreiband, Assistant Attorney General of the Civil Rights Division.
The agreement will also require Taiyo to be subject to monitoring by the government for three years. The government stated that it values the cooperation of Taiyo and is pleased to see the company take steps to ensure compliance with the law.
The alleged discrimination took place during the hiring process, when Taiyo employees asked the citizen repeated questions about their nationality, citizenship status, and immigration documents. The citizen reported the discriminatory treatment and Taiyo rescinded the job offer as a result.
The government investigation found that Taiyo had violated the antidiscrimination provision of the Immigration and Nationality Act, which prohibits employers from discriminating against employees or applicants based on their nationality, citizenship status, or immigration status.
