A 68-year-old Williamsville business owner has been convicted of tax fraud after a federal jury found him guilty of multiple counts of obstructing the Internal Revenue Service.
Carlo J. Marinello, II, was convicted of one count of obstructing and impeding the due administration of the Internal Revenue Code, four counts of failing to file personal income tax returns, and four counts of failing to file corporate tax returns with the Internal Revenue Service. The charges carry a maximum sentence of three years in prison, a fine of $250,000 or both.
Marinello, the owner/operator of Express Courier Group/Buffalo Inc., a corporation formed to commercially transport letters and documentation between businesses in New York and Canada, earned hundreds of thousands of dollars in revenues but failed to file tax returns for the company or personal tax returns for earned income.
The government’s evidence showed that Marinello hid the income and obstructed the due administration of the IRS by failing to maintain corporate books and records, destroying business records, hiding income in personal and non-business bank accounts, and using business receipts to pay personal expenses.
The defendant failed to file personal income tax and corporate tax returns for tax years 2005 through 2008. Sentencing is scheduled for November 24, 2014 at 9:00 a.m. before Chief U.S. District Judge William M. Skretny who presided over the trial.
Assistant U.S. Attorneys Russell T. Ippolito, Jr. and John E. Rogowski handled the prosecution of the case. The investigation was led by the Internal Revenue Service, Criminal Investigation Division, under the direction of Acting Special Agent in Charge Shantelle Kitchen.
