Brenda Wymer, the owner of Haven Home Care in North Wilkesboro, North Carolina, has been sentenced to a year and a day in prison for willfully failing to pay almost $1 million in employment taxes. Between 2015 and 2024, Wymer withheld taxes from her employees’ paychecks but kept the funds for herself and her business instead of paying them to the IRS. Wymer pleaded guilty to one count of willful failure to account for and pay over trust fund taxes, causing a tax loss of more than $973,000.
The timely payment of these taxes is critical to the functioning of the U.S. government, as they are the primary source of funding for Social Security and Medicare. Wymer’s actions not only cheated the government but also put the futures of her employees at risk. The IRS Criminal Investigation is investigating the case, and Trial Attorney Daniel Lipkowitz and Assistant U.S. Attorney Caryn Finley are prosecuting it.
U.S. District Court Judge Matthew E. Orso ordered Wymer to pay $973,727.04 in restitution to the United States in addition to her prison sentence. The sentence serves as a warning to business owners who attempt to cheat the system and avoid paying their fair share of taxes. The case highlights the importance of compliance with tax laws and the consequences of willfully failing to pay employment taxes.
The investigation and prosecution of Wymer’s case demonstrate the commitment of law enforcement agencies to combating tax crimes and ensuring that businesses and individuals comply with tax laws. The sentence is a significant step towards holding accountable those who attempt to cheat the system and avoiding paying their fair share of taxes.
