DALLAS, Texas – Erick Fernando Duarte, a 59-year-old convicted sex offender, was sentenced to 180 months in federal prison for his role in a child pornography case. Duarte, a resident of Garland, Texas, pleaded guilty in August 2015 to one count of possession of child pornography.
U.S. District Judge David C. Godbey handed down the sentence on Duarte. The convicted sex offender has been in federal custody since his arrest in May 2015.
According to investigators, Duarte was identified as the user who uploaded child pornography to an AOL account in April 2014. A detective with the Garland Police Department received the information from the National Center for Missing and Exploited Children (NCMEC). Duarte was identified as the user based on subscriber information and information reported on his updated sex offender registry.
A search warrant was secured and executed for Duarte’s residence and cell phone. A review of his cell phone revealed over 1,200 images of child pornography, including images of prepubescent children involved in sex acts, on his cell phone. Duarte admitted that some of the images depicted sadistic and/or violent content.
Duarte was previously convicted in the 265th Judicial District Court of Dallas County, Texas, in October 1995, for the felony assault of Sexual Assault of a Child. This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the U.S. Attorney’s Office to combat the growing epidemic of child sexual exploitation and abuse.
The FBI and the Garland Police Department investigated the case. Assistant U.S. Attorney Camille Sparks was in charge of the prosecution. Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who sexually exploit children, and identify and rescue victims.
