Texas Man Sentenced for Mailing Threats

A Texas man has been sentenced to 60 months in custody for mailing threatening communications. Carlos Kidd, 34, was sentenced on March 25, 2014, by Chief Judge Ralph R. Erickson in the U.S. District Court in Fargo, North Dakota.

Kidd was originally indicted by a federal grand jury on November 6, 2012, on two counts of Mailing Threatening Communications. He later faced six additional counts of Mailing Threatening Communications to court personnel in different North Dakota counties.

According to court documents, Kidd mailed a letter to a U.S. District Judge in Bismarck, North Dakota, on October 28, 2010, while incarcerated in Texas. The letter contained a threat to kill the judge and demanded a payment of $10,000 be issued to Kidd’s prison inmate account.

Kidd pleaded guilty to one count of Mailing Threatening Communications on February 11, 2014. He was sentenced to 60 months in custody, to run concurrent with his Texas state sentence, but consecutive to his Texas federal sentence. Kidd will also serve 2 years of supervised release and pay a $100 special assessment to the Federal Crime Victims Fund.

The case was investigated by the Federal Bureau of Investigation. Assistant U.S. Attorney Eric Kelderman prosecuted the case. Kidd was immediately turned over to the custody of the U.S. Marshals Service following his sentencing.

Kidd’s sentence serves as a reminder of the consequences of making threats. Law enforcement agencies take such threats seriously and will pursue charges to the fullest extent of the law.
