Thomas Daly, Tax Evasion, Florida 2023

A Fort Lauderdale, Florida resident has been accused of evading taxes on a staggering $1.5 million in income, according to a recent indictment. The indictment, announced by Acting Deputy Assistant Attorney General Stuart M. Goldberg of the Justice Department’s Tax Division, alleges that Thomas Daly failed to file a federal tax return since 2002, except for the 2007 tax year.

Between 2002 and 2015, Daly earned more than $1.5 million in income working as a salesman for several companies. However, in an effort to evade the collection of his back taxes, Daly allegedly incorporated South Florida Home Marketing Inc. (SFHM) to serve as his nominee and alter ego. Daly also allegedly directed others to make payments to him in the name of SFHM and used the income deposited into SFHM’s bank account to pay personal expenses, including apartment rent, a boat, international travel, entertainment, his girlfriend’s cosmetic surgery and jewelry.

The indictment charges Daly with tax evasion, alleging that he took deliberate steps to evade the collection of his back taxes. As a result of his alleged actions, the IRS’s levy was unsuccessful. Daly is accused of using the income deposited into SFHM’s bank account to pay personal expenses, which further exacerbated the issue.

An indictment merely alleges that crimes have been committed, and Daly is presumed innocent until proven guilty beyond a reasonable doubt. If convicted, Daly faces a statutory maximum sentence of five years in prison for each tax evasion count, as well as a period of supervised release, restitution and monetary penalties.

Acting Deputy Assistant Attorney General Goldberg commended special agents of IRS-Criminal Investigation, who conducted the investigation, and Trial Attorneys Charles M. Edgar, Jr. and Michael C. Boteler of the Tax Division, who are prosecuting the case with assistance from the U.S. Attorney’s Office for the Southern District of Florida.
