Attorney Sentenced for Wire Fraud in West Virginia
A court-appointed attorney in Mineral County has been sentenced for his role in a wire fraud scheme. Timothy Mark Sirk, 63, was found guilty of submitting fraudulent pay vouchers for his public defender services.
The crime occurred between December 2016 and June 2018 in Mineral County, West Virginia. Sirk admitted to forging the signature of a Circuit Court Judge when submitting the vouchers. He pleaded guilty in April 2021 to one count of wire fraud.
The West Virginia State Police investigated the case. Assistant U.S. Attorney Lara Omps-Botteicher prosecuted the case on behalf of the government. Chief U.S. District Judge Gina M. Groh presided over the case.
Sirk was sentenced to three years of probation. He was also ordered to pay $34,773.68 in restitution. The amount represents the total amount of fraudulent payments submitted by Sirk.
The investigation and prosecution of Sirk’s case serves as a reminder of the importance of transparency and accountability in the public defender system.
In West Virginia, the public defender system is designed to provide legal representation to those who cannot afford it. However, cases like Sirk’s highlight the potential for abuse and corruption within the system.
The sentencing of Sirk is a significant step towards holding those responsible for corruption accountable. It also serves as a warning to others who may be tempted to engage in similar behavior.
