Defendant Sentenced for Role in International Parental Kidnapping
BUFFALO, N.Y. – In a disturbing case of international parental kidnapping, Timothy Miller, 40, of Managua, Nicaragua, has been sentenced to time served after being convicted of conspiracy to commit the crime.
According to Acting U.S. Attorney James P. Kennedy, Jr., Miller conspired with co-defendants Kenneth Miller and Lisa Miller to assist Lisa Miller and her daughter in fleeing the United States to Nicaragua in 2009. Lisa Miller had parental rights to the child, but her partner, Janet Jenkins, also had rights. Miller’s actions were a clear attempt to prevent Jenkins from visiting the child.
Miller purchased a one-way plane ticket for Lisa Miller and her daughter to travel from Toronto, Ontario to Nicaragua. Upon their arrival, he provided them with shelter and financial assistance.
Miller’s co-defendant, Kenneth Miller, has already been convicted and sentenced. Lisa Miller, however, remains at large, along with her daughter. The authorities are still searching for them, but it appears they have evaded capture.
This case is a stark reminder of the dangers of international parental kidnapping. The fact that a defendant has been charged with a crime is merely an accusation, and they are presumed innocent until proven guilty in a court of law.
The investigation into Miller’s crimes was led by the Vermont Office of the United States Marshal’s Service under the direction of David Damag, and the Vermont Office of the Federal Bureau of Investigation under the direction of Andrew Vale, Special Agent in Charge. The sentencing is a culmination of their efforts.
Philip Zhodiates, a related perpetrator, was convicted of international parental kidnapping and conspiracy to commit the crime and sentenced to 36 months in prison.
