James McFadden, a 47-year-old truck driver once based in Grand Junction and now residing in Colorado Springs, has been indicted on five federal counts tied to the sexual exploitation of children across state lines. The charges, returned by a federal grand jury on May 17, 2019, allege McFadden repeatedly transported minors under the age of 12 across state boundaries with the intent to engage in sexual acts.
According to the indictment, between December 25, 2012, and January 3, 2013, McFadden crossed state lines intending to sexually assault a child under 12. During that same period, he allegedly transported that minor across state lines for the same purpose. A second victim was allegedly victimized between December 1, 2010, and January 1, 2011, under identical circumstances—crossing state lines with intent and transporting the child for sexual activity. A third count covers a broader timeframe, from January 1, 2007, to January 3, 2013, during which McFadden again allegedly transported a minor across state lines to commit sexual acts.
McFadden was previously convicted in Mesa County state court on multiple counts of sexual assault of children and sentenced to 324 years to life. However, he successfully appealed due to a violation of his right to a speedy trial, which barred retrial in state court. Now, federal prosecutors have stepped in, leveraging federal jurisdiction over interstate movement to bring new charges.
Authorities arrested McFadden at approximately 8:00 a.m. on Tuesday in Colorado Springs. He was transported to the federal courthouse in Grand Junction, where he made his initial appearance before U.S. Magistrate Judge Gordon P. Gallagher. The case is being prosecuted by Assistant U.S. Attorney Jeremy Chaffin.
The investigation was led by the FBI Denver Field Office and the Grand Junction Police Department, with support from the 21st Judicial District Attorney’s Office. The case was brought as part of Project Safe Childhood, a Department of Justice initiative launched in 2006 to combat child sexual exploitation through coordinated federal, state, and local efforts.
The charges in the indictment are allegations. James McFadden is presumed innocent unless and until proven guilty in a court of law. Case number 19-cr-00243 is ongoing in the U.S. District Court for the District of Colorado.
