VA Contractor Jailed 18 Months for $2.2M Tax Heist
A former Virginia-based defense contractor has been sentenced to 18 months in prison for failing to collect and pay $2.2 million in employee payroll taxes and stealing $186,000 from an employee pension plan.
William P. Danielczyk Jr., 53, was the executive chairman of Innolog Holdings Corporation, which acquired Innovative Logistics Technology Inc. in March 2009. The company provided technology-supported logistics services to the U.S. military and various defense organizations.
Between mid-2009 and the end of 2011, Danielczyk was responsible for collecting, accounting for, and paying appropriate payroll tax amounts to the IRS. However, he failed to pay both the employee withholdings amounts and the employer’s matching portions to the IRS, resulting in a total tax loss of $2,232,781.
Danielczyk also failed to send payments to the asset custodian for Innovative’s employees’ pension plan contributions, leading to a total loss of $186,263. Instead of paying the company’s employment taxes and pension plan contributions, Danielczyk made various purchases from company accounts, including $505,871 for an executive suite at FedEx Field and $40,000 to sponsor the Virginia Gold Cup.
Danielczyk was previously sentenced to 28 months in prison for a campaign finance scheme and is already serving that sentence. He will serve his new 18-month sentence consecutively.
Deputy Assistant Attorney General Ronald Cimino, U.S. Attorney Dana J. Boente, and Assistant Secretary Phyllis C. Borzi made the announcement after sentencing. Special Agent in Charge Thomas J. Kelly for the IRS-CI Washington, D.C. Field Office also participated.
Danielczyk pleaded guilty on June 10 and was ordered to serve three years of supervised release after his prison sentence and to pay over $1.6 million in restitution to the IRS.
