SWANTON BEND, IN – In a stunning turn of events late yesterday, 47-year-old Gary Schmucker from Warsaw, Indiana, was found guilty by a jury after a two-day trial, presided over by United States District Court Judge Damon R. Leichty.
The jury delivered a verdict of guilty against Schmucker on the sole count of the Indictment charging him with possessing a firearm as an unlawful drug user. Sentencing for this severe offense is set for November 25, 2025, at 10:00 AM, at which time District Court Judge Leichty will determine the specific sentence to be imposed after considering federal statutes and the United States Sentencing Guidelines.
According to Acting United States Attorney M. Scott Proctor, this case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), with valuable assistance from the Kosciusko County Sheriff’s Department. Assistant United States Attorneys Joseph P. Falvey and Jerome W. McKeever handled the prosecution.
