Winner Man Pleads Guilty to Gun Charge
A 39-year-old Winner man has pleaded guilty to possessing a firearm after being convicted of domestic violence, violating federal law.
Joshua Felix, of Winner, South Dakota, appeared before U.S. District Judge Roberto A. Lange on April 2, 2013, and entered a guilty plea to Prohibited Person in Possession of a Firearm.
According to court documents, Felix was convicted of domestic violence simple assault on June 15, 2004, in Tripp County. As a result, he was prohibited from possessing firearms under federal law.
On March 15, 2012, law enforcement discovered Felix in possession of a rifle, sparking the investigation. The Tripp County Sheriff’s Office and the Rosebud Sioux Tribe Law Enforcement Services collaborated on the case.
Assistant U.S. Attorney Timothy M. Maher is prosecuting the case, which is set for sentencing on June 24, 2013. A presentence investigation has been ordered, and Felix was remanded to the custody of the U.S. Marshal pending sentencing.
The maximum penalty for Felix’s conviction includes 10 years in custody, a $250,000 fine, or both; 3 years of supervised release; and a $100 special assessment.
