Richard Alan Kucera, Sex Trafficking of a Child and Production of Child Pornography, South Dakota 2024

United States Attorney Alison J. Ramsdell has announced a grim verdict from Pierre, South Dakota. Richard Alan Kucera, 67, of Winner, has been found guilty on two counts of Sex Trafficking of a Child and two counts of Production of Child Pornography after a four-day federal trial.

Each charge against Kucera carries severe penalties: at least ten years for sex trafficking, with a life sentence as the maximum; and fifteen to thirty years for producing child pornography. The judge could also impose fines exceeding $500,000, mandatory supervised release, and special assessments to the Federal Crime Victims Fund.

The evidence presented at trial showed Kucera’s involvement in a heinous scheme with co-defendant Ivy Heron, 37, who pleaded guilty earlier this year to Conspiracy to Engage in Sex Trafficking of a Child. The duo recruited local girls for sex acts and paid Heron for each girl they managed to ensnare.

Kucera, the jury determined, not only engaged in these criminal acts but also produced explicit images and videos of the minors involved, which he shared on Facebook. The operation came to light in June 2022 when law enforcement interviewed the victims.

This case was a collaborative effort, led by the FBI, with Assistant U.S. Attorney Kirk Albertson handling the prosecution. It is part of Project Safe Childhood, a Justice Department initiative aimed at combating child sexual exploitation and abuse.

A presentence investigation is underway, and Kucera has been remanded to the custody of the U.S. Marshals Service pending his sentencing.
