WASHINGTON – A Utah agency has been ordered to pay a fine for violating labor rights, according to a settlement reached by the U.S. government.
1st Class Staffing, LLC, a staffing agency based in Orem, Utah, has agreed to pay $17,600 in civil penalties and provide training to its employees on antidiscrimination laws, as part of a settlement with the U.S. government.
The investigation, led by the Office of Special Counsel for Immigration-Related Unfair Employment Practices (OSC), found that 1st Class Staffing’s Fontana, California office had routinely requested specific immigration documents from non-U.S. citizens, but not from U.S. citizens.
The INA prohibits employers from limiting the choice of documents that employees can present to demonstrate their work authorization based on their citizenship, immigration status, or national origin.
According to the terms of the settlement, 1st Class Staffing will pay retroactive wages to the complainant whose complaint triggered the investigation and will provide training on antidiscrimination laws.
The OSC is responsible for enforcing the antidiscrimination provision of the INA, which prohibits discrimination based on citizenship, immigration status, or national origin in the hiring, firing, or recruitment process.
