Timothy Tundo, Machine Gun Possession, New York 2021

BUFFALO, N.Y. – A gritty plea has been entered by Timothy Tundo, 62, of Bethany, NY, as he stood before U.S. District Judge Lawrence J. Vilardo for possession with intent to distribute LSD, possession of firearms in furtherance of drug trafficking, and unlawful possession of machine guns.

The charges against Tundo carry a severe penalty: a mandatory minimum of five years in prison, stretching to life imprisonment. The U.S. Attorney Michael DiGiacomo’s office confirmed the news today.

In February 2021, law enforcement officers executed a search warrant at Tundo’s residence. The search revealed not just drugs but a arsenal of weaponry. Among their findings: LSD, oxycodone, marijuana, two machine guns, three assault weapons, 12 long guns, five pistols, a cap gun, ammunition, magazines, $2,500 in cash, and drug paraphernalia.

Assistant U.S. Attorneys Joshua A. Violanti and Stacey Jacovetti are handling this case. The plea follows an investigation led by the Genesee County Sherriff’s Office under Sheriff Joseph Graff and the Bureau of Alcohol, Tobacco, Firearms, and Explosives with Special Agent-in-Charge Bryan Miller.

Sentencing is set for November 14, 2025, at 9:30 a.m. before Judge Vilardo. Tundo’s guilty plea could seal his fate in the gritty world of federal crime news.
