Letitia James, Clinic Access Violation, New York 2023

New York – In a landmark ruling, Attorney General Letitia James announced victory against anti-abortion group Red Rose Rescue. The organization was found guilty of violating state and federal clinic access laws through their aggressive tactics that hindered reproductive health care access.

‘This is a monumental victory for the rule of law, for reproductive freedom, and for every patient who has been harassed, intimidated, or blocked from accessing the health care they need,’ James stated. The court deemed Red Rose Rescue’s actions not peaceful protest but unlawful obstruction, emphasizing New York’s stance against such conduct.

The lawsuit, filed in June 2023, accused Red Rose Rescue of trespassing, obstructing clinic entrances, and disrupting medical services. U.S. District Court Judge Kenneth M. Karas confirmed that the group coordinated efforts to invade clinics, block entrance, and resist law enforcement, violating the federal Freedom of Access to Clinic Entrances (FACE) Act and New York Clinic Access Act.

Attorney General James vowed to protect patients and reproductive health care providers, reinforcing New York as a safe haven for reproductive care. The ruling mandates further proceedings to determine appropriate remedies for Red Rose Rescue’s unlawful actions.

The FACE Act and the New York State Clinic Access Act are designed to ensure that individuals inside and outside clinics can obtain or provide reproductive health care without fear of obstruction. For those who believe these laws have been violated, the Attorney General’s Civil Rights Bureau offers a complaint process via phone, email, or online submission.
