Assaulting a Federal Officer Sparks Investigation
A disturbing incident in Porcupine, South Dakota, has led to the indictment of Scotty Old Horse, an 18-year-old from Kyle, for assaulting a federal officer.
According to the indictment, which was handed down on November 19, 2013, Old Horse resisted a law enforcement officer employed by the Oglala Sioux Tribe Department of Public Safety while the officer was engaged in the performance of his official duties.
The maximum penalty upon conviction is up to 10 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
Assistant U.S. Attorney Kathryn N. Rich is prosecuting the case, which is being investigated by the Bureau of Indian Affairs, Office of Justice Services, and the Oglala Sioux Tribe Department of Public Safety.
Old Horse appeared before U.S. Magistrate Judge Veronica L. Duffy on December 2, 2013, and pled not guilty to the indictment. He was released on bond pending trial, with a trial date set for February 4, 2014.
The charge against Old Horse is merely an accusation, and he is presumed innocent until and unless proven guilty.
The incident highlights the dangers faced by law enforcement officers in the line of duty and the importance of holding those responsible accountable for their actions.
