Washington D.C. – The Commodity Futures Trading Commission (CFTC) announced today it has awarded a whistleblower for providing crucial information that led to a successful enforcement action against undisclosed fraudulent activity. The agency highlighted the significant role the whistleblower played, not only with the initial tip but also with extensive follow-up assistance and documentation.
According to the CFTC, the violations would have been “difficult to detect” without the whistleblower’s contributions. James McDonald, Director of the Division of Enforcement, stated the assistance allowed the CFTC to expedite the investigation and conserve agency resources. Christopher Ehrman, Director of the Whistleblower Office, emphasized the importance of the program in protecting investors.
The CFTC’s Whistleblower Program, established under the Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, incentivizes individuals to report potential violations of commodity trading laws. Since 2014, the agency has awarded approximately $120 million to whistleblowers, resulting in nearly $950 million in monetary relief recovered through related enforcement actions. The awards are linked to both CFTC-led cases and actions brought by other regulatory bodies, under specific conditions.
Whistleblowers are eligible for awards ranging from 10 to 30 percent of the monetary sanctions collected. These awards are funded entirely by the CFTC Customer Protection Fund, sourced from penalties paid by violators, and do not impact funds available to injured customers. The CFTC maintains strict confidentiality protections for whistleblowers, shielding their identities except in limited circumstances.
The agency declined to disclose details about the specific enforcement action or the precise amount of the award, citing confidentiality concerns.
