Benjamin George Murphy, a 65-year-old man from Rosebud, South Dakota, has been sentenced to 36 months in custody for Abusive Sexual Contact. The sentencing took place on April 9, 2013, in a U.S. District Court, with Judge Roberto A. Lange presiding.

The conviction stems from an incident that took place between December 1, 1999, and December 15, 1999. During this time, Murphy, who was a teacher at the Rosebud Elementary School, had sexual contact with a student he helped teach.

According to the indictment, Murphy was charged on August 22, 2012, and subsequently pled guilty to the charge on January 9, 2013. The prosecution was led by Assistant U.S. Attorney Timothy M. Maher.

The investigation into the incident was conducted by the Federal Bureau of Investigation and the Rosebud Sioux Tribe Law Enforcement Services. The collaborative effort between the two agencies ultimately led to Murphy’s conviction.

As part of the sentencing, Murphy was also ordered to pay a $100 special assessment to the Victim Assistance Fund and will be subject to 2 years of supervised release upon completion of his sentence.
