Niagara Falls Man Sentenced for Child Pornography

BUFFALO, NY – A 40-year-old Niagara Falls man, with a prior conviction of child sexual abuse, has been sentenced to 188 months in prison for his latest child pornography charge.

Albert Smith, 40, was sentenced by U.S. District Judge Lawrence J. Vilardo, after being convicted of possession of child pornography involving a prepubescent minor and having a prior conviction under the laws of any state relating to sexual abuse involving a minor.

The investigation began in 2021, when a search warrant was executed at Smith’s residence, during which investigators seized two cell phones and an electronic device containing child pornography, which Smith had attempted to discard.

According to Assistant U.S. Attorney Maeve E. Huggins, who handled the case, Smith possessed 314 images and 25 videos of child pornography on the three devices, including depictions of prepubescent minors less than 12 years old, and the sexual abuse of an infant or toddler.

The sentencing is the result of an investigation by the Niagara Falls Police Department, under the direction of Superintendent Nicholas Ligammari, and the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Matthew Miraglia.

Smith’s prior conviction of sexual abuse involving a minor dates back to 2003, when he was convicted in North Tonawanda City Court of Sexual Abuse 2nd: Sexual Contact with Person Less Than 14 Years Old.

Smith’s latest conviction and sentence bring him one step closer to being held accountable for his heinous crimes, and serve as a reminder that child predators will be prosecuted to the fullest extent of the law.
