ALEXANDRIA, Va. — Dr. Lino Cueto Montilla, a practicing obstetrician-gynecologist from Annandale, Virginia, has pleaded guilty to maintaining a drug-involved premises, according to court documents. The charges stem from Montilla’s alleged excessive prescribing of opioids at the Fairfax Pain Clinic (FPC) over a period of four years.
Montilla, 57, was licensed to practice medicine since 1995 but did not specialize in pain management or receive training on treating chronic pain. From January 2016 to September 2020, he worked as the primary prescriber at FPC, where he saw and prescribed opioids to about 20 patients each weekday morning for less than 10 minutes per patient.
Despite conducting superficial exams and often failing to document his reasons for high opioid dosages, Montilla prescribed excessive amounts of Schedule II controlled substances without confirming diagnoses or reviewing medical records. He rarely referred patients to physical therapy or other treatments. Montilla’s limited documentation in patient files raised red flags.
Scheduled for sentencing on August 9th, Montilla faces up to 20 years in prison. U.S. Attorney Jessica D. Aber and FBI Special Agent David J. Scott announced the plea after it was accepted by Senior U.S. District Judge Claude M. Hilton. Assistant U.S. Attorneys Jack Morgan and Zoe Bedell are prosecuting the case.
