Albuquerque Man Sentenced to 30 Years for Child Pornography
ALBUQUERQUE – In a shocking case of child exploitation, Antonio Gutierrez, 44, of Albuquerque, New Mexico, was sentenced to 30 years in federal prison for producing child pornography.
According to the U.S. Attorney’s office, Gutierrez was convicted on three production of child pornography charges. He will be required to pay $14,060 in restitution to the victim and register as a sex offender for five years after his release from prison.
The case began in August 2012, when Gutierrez was arrested based on a criminal complaint alleging that he induced a minor to engage in sexually explicit conduct for the purpose of producing child pornography.
Prosecutors alleged that Gutierrez committed the offenses between August 2011 and November 2011 in Bernalillo County, New Mexico. The evidence at trial established that Gutierrez gave the victim a cellphone on her 16th birthday and told her that he would pay for the first month of service, but only if she provided him with nude photographs of herself.
The victim, who was just 16 years old at the time, was coerced into sending Gutierrez explicit images of herself every month, with the nature and extent of the sexual conduct escalating with each passing month. In November 2011, the victim reported Gutierrez’s unlawful conduct to the Albuquerque Police Department, and a search warrant was executed at Gutierrez’s residence.
Forensic examination of Gutierrez’s personal computer revealed many sexually explicit photographs, including images of the victim taken by Gutierrez. Despite testifying in his own defense, Gutierrez denied producing any child pornography and claimed that he did not know how the images ended up on his computer.
The case was investigated by the Albuquerque office of the FBI, the Albuquerque Police Department, and the New Mexico Regional Computer Forensic Laboratory. Assistant U.S. Attorneys Jennifer M. Rozzoni and Marisa A. Lizarraga prosecuted the case as part of Project Safe Childhood, a nationwide initiative to combat child sexual exploitation and abuse.
Project Safe Childhood is a collaborative effort between federal, state, and local law enforcement agencies to locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. The case was also brought as a part of the New Mexico Internet Crimes Against Children (ICAC) Task Force’s mission to locate, track, and capture Internet child sexual predators and Internet child pornographers in New Mexico.
